Unfairpak can advise that the cut off date for registering claims, updating names, changes of address etcetera has been extended until 7 August 2012 due to the volume of calls, emails etcetera by customers querying various points.

Please note that a PHOTOCOPY will suffice when you have to provide copy death certificate.

Same applies for a Marriage Certificate, a PHOTOCOPY will suffice.

Cheques will now begin to go out in September instead of August.

This follows the appointment of Martha H Thompson and Shagun Dubey of BDO LLP, Kings Wharf, 20-30 Kings Road, Reading, Berkshire, RG1 3EX as Joint Administrators over the assets and business of Farepak on 13 October 2006.

Extension of Final Deadline to Submit Customer and Agent Claims

Following the announcement that the Joint Liquidators will be making dividend payments to creditors, including customers and agents, a number of people have asked for additional time so that they can make sure they have sent in their claims and have updated their personal details.

The Joint Liquidators can confirm that they will give customers and agents an additional three weeks, up to 7 August 2012, to make sure their claims and details are correct.

Because customers and agents are being allowed this extra time, this will mean that the Joint Liquidators will send out cheques during September.

Customers and agents who need to contact the Claims Management Team to submit a claim or to update their details should do so by 7 August 2012 by writing to Claims Management Team, Farepak Food & Gifts Limited – In Liquidation, PO Box 3404, Swindon, SN2 9EQ.

After 7 August 2012, the Joint Liquidators will begin the process of producing cheques and all of the money held by the Liquidators will be paid to creditors, including customers and agents, during September. This will mean that the Joint Liquidators will not be able to accept new claims from customers and agents that are sent in after 7 August 2012.

Joint Liquidators announce dividend payment

The Joint Liquidators of Farepak have announced that they will be making dividend payments to Farepak’s creditors, including customers and agents. In addition, the Joint Liquidators will at the same time distribute the £8million ex-gratia payment to customers and agents made by Lloyds Banking Group. The ex-gratia payment will be issued by the Joint Liquidators at no additional cost. The dividend payment – approved by the Liquidation Committee – marks the end of the liquidation of Farepak for creditors.

The Joint Liquidators have been working throughout the liquidation to recover as much money as possible for creditors as directed by the Liquidation Committee, which was set up by court order to represent all those who lost money as a result of the collapse of Farepak. This work has required the Joint Liquidators to investigate a number of possible claims and engage in legal proceedings with third parties. The Joint Liquidators have now finished their investigations and recovered as much money as possible for creditors and are in a position to pay a dividend.

Farepak collapsed leaving no money to pay a dividend to its creditors. The Joint Liquidators are now able to confirm that a payment will be made to customers and agents of approximately 32p in the £. This sum includes the dividend payment of approximately 13p in the £ secured by the Joint Liquidators and the £8million ex-gratia payment made by Lloyds Banking Group. The Joint Liquidators will aim to make payments to Farepak’s 114,000 creditors during September.

When added to the 17.5p in the £ given to all customers and agents by the Farepak Response Fund charity, set up by the Department for Trade and Industry in 2006, the dividend payment means that customers and agents of Farepak will have received a total of approximately 50p in the £.

By law, the Joint Liquidators must take certain steps during the time between the announcement of the dividend payment, and when the cheques are sent out to all creditors including customers and agents.

The Joint Liquidators have also agreed to give customers and agents an extra three weeks to allow them to provide information about their claims and to update their personal details.

Based on the time needed to complete the above, the Joint Liquidators will aim to make payments during September.

 

1. How much money will I get? 

The work undertaken by the Joint Liquidators has increased the dividend payable to approximately 13p in the £, compared to nothing when Farepak went into administration. The Joint Liquidators will also distribute the £8m ex-gratia payment to customers and agents made by Lloyds Banking Group at the same time as the dividend payments, This will mean that customers and agents will receive a total payment of approximately 32p in the £.

This will mean that, for example:

– a customer or agent with a claim of £100 will receive approximately £32;

– a customer or agent with a claim of £500 will receive approximately £160; and

– a customer or agent with a claim of £1,000 will receive approximately £320.

The Joint Liquidators will aim to make payments to Farepak’s 114,000 creditors during September.

 

2. Why are payments being made by cheque, and not directly into bank accounts?

 

The Joint Liquidators are making the dividend payments by cheque because it is the best way of ensuring the money reaches the right person in this case.

 

3. Is this the final payment I will receive?

 

The dividend payment is the total and final payment that will be made to creditors. The dividend payment marks the end of the liquidation of Farepak for creditors, including customers and agents.

 

4. Why has the estimated dividend changed?

 

As with all administration and liquidation processes, it is not possible to calculate the exact dividend payment until all monies are recovered, the final number of creditors is known and all work is completed. For this reason, all dividend figures that have been shared by the Joint Liquidators (formerly Joint Administrators) to date have been based on projections and clearly set out as estimates.

 

As directed by the Liquidation Committee, which was set up by court order to represent all those who lost money as a result of the collapse of Farepak, the Joint Liquidators have been working throughout the course of the administration and liquidation to recover as much money as possible for creditors, including customers and agents. The Claims Management Team is not able to deal with changes of name over the telephone or via email for security reasons. The Joint Liquidators can confirm that customers and agents do not need to send in original certificates.

Notification of customer / agent death

 

We are not able to deal with notifications of death over the telephone for security reasons.   1. i was a fully paid up customer (£500) at the time of the collapse, Is it only people who filled in the claim form at the time who will receive this money or will all customers receive this payout?

  2. Hi I was an agent when farpak collapsed and at time i thought i would not get anything back so i threw out all i had regarding farpak and my customers.Will I be able to claim if i dont have my agents number?
    Surely the liquidators will have my details if i give them my address.

  7. hi, myself, my mother and my sister both lost 900 pound each at the time and filled out a claim form when it happened. we were not aware of this new refund this year and neither was our agent. will we recieve any money back?

  9. Hi there just want to check, will myself & my customers get a pay out? Completed all claim forms etc in 2006, received a small payout a few years ago but I was not aware of having to do anything this year.

    • Hi Maretta

      Cheques have not started going out yet hence the reason you have not received anything. You should expect to receive your cheque this month.

      I would suggest registering on Unfairpak’s forum as I will post when the cheques are being printed and when they are being mailed out.

  11. Hi suzy,I was’nt aware we had to inform claims management team (farepak) of any changes of names,death etc.Is it to late to do this?will my customers still get a payout ever though I have’nt made a fresh claim?

    • Hi if any customer has changed name or address they must still notify. Cheques will be on there way soon but returned cheques will be resent with correct name address etc

  13. My eldest daughter was an agent, but sadly passed away last year. I notified the claim dept and sent death certificate. I received their reply. I now know that money is being paid direct to customers. My other daughter now tells me that she moved late 2006 and she may be rejistered at her old address, also her sister may have entered her in her maiden name ( simply because its what she is known by locally) please can you help.

  15. I was an agent and had about 5 customers when farepak folded. At the time I registered my claim and that of my customers. I was not aware that we were supposed to register again this year until it was too late, a friend showed me a tiny newspaper scrap that had a couple of lines telling people of the deadline, unfortunately, by the time I saw it the deadline had passed. Is it likely that we will still get anything back, and if so, will the money be sent to me or directly to my customers? I know at least one of them has moved house. Also, I can no longer find the details of how much each person had paid as we moved house a couple of times and all of my paperwork seems to have gotten lost along the wayside.
    I would appreciate any advice or information that you could offer. Thankyou.

    • Firstly, you do not need to submit another claim. The article was regarding people who had NOT submitted claim.

      Anyone who has moved house is responsible THEMSELVES for notifying the Claims Management Team, Farepak Food & Gifts Limited in Liquidation PO Box 3404 Swindon SN2 9EQ of their old and new address.

      Payments go direct to each individual. So you will receive your payment and your customers will receive theirs.

  16. HI I HAVE JUST FOUND YOUR SITE AND AFTER READING IT HAVE REALISED THAT AGENTS WHERE SUPPOSE TO HAVE GOT A CHEQUE IN 2006 I DID NOT RECEIVE THIS AND WAS WONDERING WHAT I COULD DO

    • the cheque in 2006 was not from farepak but was from the Sun’s collection fund….it worked out to approximately 18p in every pound paid in

    • Cheques are in postal system as of today Jackalyn. No they do not need to be signed for. If your daughter and son in law have changed address and do not receive cheque they need to write to Claims Management Team, Farepak Food & Gifts Limited in Liquidation PO BOX 3404 SWINDON SN2 9EQ with details of their old and new address.

  18. jackalyn solomon i have just recieved my cheque of which i am really not happy i ordered £1600 pounds worth of vouchers before they went bust and i had 1 more payment to make . £1000 of that was mine and my daughter and son had £300 pound each.i have just recieved £71-31 really dont understand this my daughter has just recieved £149-75 something is very wrong here can someone reply as soon as possible please

  19. hi i have just been informed of the payout and havent herd from my agent either how ami supposed to claim my money back and my husband as we have moved now but dont have any contact anymore with the agent who we paid our money to. please help as i have just been told by a friend that this should have been done by august shouldnt we have been told as well.

          • Hi I have just phoned then and they said I have missed the dead line to claim payment. If they are in liquidation they should have all my details!! i thought it was too good to be true. I have lost a lot of money. NOT HAPPY

            you asked Unfairpak for help back on July 18th this year! Did you not submit a claim then as you still had plenty time to do so?

            If you did not submit claim there is nothing you can do as the deadline has passed.

      • Hi Thanks for your reply.I dont read newspapaers and have limited access to the internet so what about these people who do not have access to these? Have they lost their money too?.I have never recieved any money or notifiction from farepak about them in liquidation which I should have been notified by law.Also what happens to the money left over after everyone who made a clain is paid?

  20. Hi my agents other savers have all had their cheques. I’m worried about mine. I moved a month ago but all our mail is being redirected by the royal mail. Why do you think mine has not arrived and can I even find out if it’s been sent out?

  21. I am a fairpak customer, I am still waiting on my cheque to arrive. I have phoned the above number, and I get told a different story every time. I just want my cheque or answer as to why I have not received.

    • What are you being told Tracey? We are the campaign group so do not have access to the database but if you let me know what you are being told I can try and look into matters for you.

  22. Suzy, I am also a customer who has not received their cheque from Farepak although my agents other customers have received theirs. As my surname begins with T which may mean its towards the end of the pile or there is a problem I don,t know. Can you throw any light on this issue.

  23. can some help me please!! my agent called me today and said she recieved a cheque from farepak last week, she said i should have recieved one but would have gone to my old address. iv done some research got what i think is the right address to inform them iv moved but agent is now telling me she not got her agent number. what can i do??

  24. I sent a letter to the claims department (as did my mother) early November informing them we had not received a cheque. I phoned them today and they say cheques were sent out to us on Oct. 17th.?! However they say they will cancel these these and print new cheques to us which we should receive in 21-28 days. I know through our agent another 4 people have also not received theirs yet either! So now I have to wait again and see IF the cheque comes.

  25. I was wondering if I would get my cheque as I was not aware that I had to inform Farepak about change of address. My agent never told me. I have wrote to the claim management team but never got a response, which I thought was disgusting.

    I received a letter today from farepak liquidators the first letter since they went into administration.I am very angry with them as they told me that I missed the deadline an I wont get any cheque what makes me more angry is that they had all my details ,payment agent numbers etc yet i wont get any payment. The administrators have done a very poor job in dealing with this.What has happened to the money left over for those who did not claim?I am sure i speak for those other victims who missed out. What a farse!!!!!!!!!
